The mobile application Kartcure and website www.kartcure.com are owned and operated by Kartcure.com (JDM ENTERPRISES), a business entity operating under the laws of India (hereinafter referred to as “Kartcure”, “We”, “Our”, “Us” or “Company”). The domain name and mobile application are collectively referred to as the “Website”.

The User, by placing an order through the Kartcure website or mobile platform, is deemed to have consented to these terms and conditions. Kartcure reserves the right to modify these terms from time to time without prior notice. Users are advised to review these terms periodically.

GENERAL

This document is an electronic record generated by a computer system in accordance with the Information Technology Act, 2000 and applicable rules, and does not require physical or digital signatures.

This document is published in accordance with Rule 3(1) of the Information Technology (Intermediaries Guidelines) Rules, 2011 which requires publishing rules, regulations, privacy policy and Terms of Service for access or usage of www.kartcure.com.

OWNERSHIP

This website and application are owned and operated by Kartcure (JDM ENTERPRISES). By registering as a user you are granted a limited, revocable and non-exclusive license to access and use the website. Kartcure may terminate this license at any time without notice.

All website content including text, graphics, logos and product information is protected under applicable intellectual property laws of India.

TERMS AND CONDITIONS

These terms together with the privacy policy form a legally binding agreement between the User and Kartcure under the Indian Contract Act, 1872. In case of conflict, these Terms and Conditions shall prevail.

SHIPPING AND DELIVERY

• The sale is deemed concluded when the invoice is generated by Kartcure.
• Products will be delivered through courier partners or logistics providers to the delivery address provided by the customer.
• Shipping charges, taxes and other fees may apply depending on order value and location.
• Delivery timelines vary based on location and courier partner availability.
• The user is responsible for providing accurate delivery details while placing the order.
• Kartcure will not be responsible for delays caused by courier companies, weather conditions or unforeseen circumstances.

RETURN, REFUND AND CANCELLATION POLICY

• If the user receives a damaged or incorrect product, Kartcure will provide a replacement or refund subject to verification.
• The user must report the issue within 48 hours of delivery along with supporting photos.
• Refunds will be processed within 7-10 working days after approval.
• If no complaint is received within 7 days, the order will be considered accepted.
• Orders once shipped cannot be cancelled.
• If delivery is refused or cancelled after dispatch, applicable courier charges may be deducted.

PRICING

• Kartcure may run promotional offers or discounts at its discretion.
• Prices are subject to change without prior notice.
• Payments may be made through UPI, Debit Card, Credit Card, Net Banking or Cash on Delivery where available.
• All applicable taxes will be included in the final invoice.

INDEMNITY

The user agrees to indemnify and hold harmless Kartcure, its employees, partners and affiliates from any losses or damages arising from misuse of the website or violation of these terms.

GOVERNING LAW

These terms shall be governed by the laws of India. Any disputes shall be subject to the jurisdiction of courts located in Ghaziabad, Uttar Pradesh.

REFUSAL OF SERVICE

Kartcure reserves the right to refuse service to anyone at any time without assigning any reason.

LIMITATION OF LIABILITY

Kartcure shall not be liable for any indirect, incidental or consequential damages arising from the use of the website or products purchased through it.

ELIGIBILITY

Users must be at least 18 years of age or using the website under supervision of a parent or legal guardian.

ONLINE SECURITY

Kartcure maintains reasonable security measures to protect user information. Users are prohibited from attempting unauthorized access or disrupting website operations.

FORCE MAJEURE

Kartcure shall not be held responsible for delays or failure in performance due to events beyond reasonable control including natural disasters, strikes, government restrictions, technical failures or other unforeseen circumstances.

TERMINATION

Kartcure reserves the right to suspend or terminate user access to the website in case of violation of these terms.
